  • VitalLaw’s Fifty State Construction Lien and Bond Law Guide

This handbook is designed to provide the critical information essential to determining and   perfecting lien and bond rights and it addresses perfecting the project professional’s lien rights through the timely and proper notice of the lien, timely and proper recordation of the lien, and timely suit to enforce the lien.

Notice of Completion (NOC)

Critically important in California, this recorded document provides you with the deadlines for recording a Mechanics Lien or serving a Stop Payment Notice.

Recording of the NOC officially marks the completion of a project, and once it is recorded, the countdown begins for contractors, subcontractors, and suppliers to take legal action if they have not been paid.

You often are not notified of the recording of a NOC by the project owner. Your time for recording your lien or serving your SPN is determined by the NOC. Without knowing that the NOC has been recorded, your time to file those notices to secure payment may be lost.

FAQ:

How does the NOC impact my ability to secure payment?
The NOC starts the clock for filing a Mechanics Lien or serving a Stop Payment Notice. Without knowledge of the NOC’s recording, you risk losing your payment rights due to expired deadlines.

Can I file another lien if I missed the deadline for an existing lien?
Yes, as long as the NOC has not been recorded or the project is still open, you may still have time to file another lien.

Will the project owner notify me of the NOC?
Not necessarily. Owners are not required to notify all parties when an NOC is recorded, which is why it is essential to have a monitoring service in place to alert you.

What if my company receives the NOC late?
Larger companies may face delays in internal communication. A direct notification service ensures that the responsible parties are alerted in time to take action.
